1. DEFINITIONS AND INTERPRETATION 1.1 "The Company" refers to Kenike Cars, operating as a licensed private hire operator under UK regulations. 1.2 "The Customer" or "The Passenger" refers to any individual, group, or corporate body booking transport services with the Company. 1.3 "The Booking" refers to the contract for a journey, hourly hire, or recurring service agreed between the Company and the Customer. 2. BOOKINGS AND CONFIRMATIONS 2.1 Submission: All booking requests must be made via the official Company website, mobile application, email, or telephone booking line. 2.2 Contract Formation: A booking request constitutes an offer by the Customer. A binding contract is only formed when the Company issues a formal digital booking confirmation via SMS, email, or app notification. 2.3 Vehicle Capacity: The passenger and luggage capacity of each vehicle is strictly regulated by law. The Company reserves the right to refuse carriage if the number of passengers or amount of luggage exceeds the legal limit of the vehicle booked. 3. PRICING, FARES, AND ADDITIONAL CHARGES 3.1 Base Quoted Fares: Quoted prices are calculated based on the specific route, pick-up time, date, and vehicle class selected at the time of booking. 3.2 Dynamic Additions: Final fares may be subject to additional fees including, but not limited to: UK congestion zones, low emission zone charges, toll roads, parking fees, and airport drop-off/pick-up charges. 3.3 Waiting Time & Grace Periods: • Standard Pick-ups: A grace period of 10 minutes is included. Thereafter, waiting time is charged at £0.45per minute. • Airport Pick-ups: A grace period of 45 minutes from the actual flight landing time is included. Additional waiting time will incur standard waiting rates. 3.4 Vehicle Soiling & Damage: If a passenger soils, damages, or vomits inside the vehicle, a cleaning and restoration fee of up to £[Insert Amount, e.g., 100 or 150] will be applied to cover professional cleaning costs and lost vehicle operational time. 4. CANCELLATIONS, AMENDMENTS, AND NO-SHOWS 4.1 Free Cancellation Window: Bookings may be amended or cancelled free of charge up to 1 hour, e.g., 2 or 24 hours before the scheduled pick-up time. 4.2 Late Cancellation Fees: Cancellations made within the restricted window will be subject to a cancellation charge equal to 10% of the total estimated journey fare. 4.3 No-Show Policy: If a passenger fails to present themselves at the designated pick-up location within 10 minutes of the scheduled time (or airport arrival time after the grace period of 45 minutes) without contacting the Company, it will be classified as a "No-Show". The booking will be cancelled, and the full fare remains payable. 5. PASSENGER CONDUCT AND RESPONSIBILITIES 5.1 Right of Refusal: In accordance with UK transport safety guidelines, drivers are authorised to refuse carriage or terminate a journey immediately if any passenger is abusive, threatening, heavily intoxicated, or acts in a manner that compromises the safety of the driver or vehicle. 5.2 Safety Regulations: It is a strict legal requirement under UK law for all passengers to wear seatbelts at all times while the vehicle is in motion. 5.3 Prohibited Activities: Smoking, vaping, illegal drug use, and the consumption of alcohol are strictly prohibited inside all Company vehicles at all times. 6. LIABILITY AND FORCE MAJEURE 6.1 Unforeseen Delays: While the Company makes every reasonable effort to ensure punctual arrivals, it accepts no financial liability for missed flights, train connections, business meetings, or scheduled events resulting from circumstances beyond its control (including severe traffic congestion, road traffic accidents, extreme weather, or sudden mechanical failure). 6.2 Travel Planning: Customers are strongly advised to factor in sufficient buffer times when scheduling transport for time-sensitive connections, particularly airport transfers. 7. DATA PROTECTION (UK GDPR) 7.1 Information Security: The Company collects and processes personal passenger data in full compliance with the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018. 7.2 Third-Party Disclosure: Passenger data is kept confidential and will only be shared with authorised drivers to execute the transport service, or with licensing authorities and law enforcement where required by law
